Overview

These Terms of Service ("Terms") govern your use of services provided by OnyxLabs Private Limited ("OLabs", "we", "us", or "our"), including My Condoproperty management platform. By accessing our website or using our services, you agree to be bound by these Terms.

1. Use of Services

By using our services, you acknowledge that:

  • You have a limited, non-exclusive license for personal or business purposes
  • Account registration requires accurate and complete information
  • You are responsible for maintaining account security and confidentiality
  • You must notify us immediately of any unauthorized access
  • You are responsible for all activities under your account

2. Intellectual Property Rights

All content on our platform, including but not limited to text, graphics, logos, software, and documentation, is owned by OLabs and protected by intellectual property laws.

You may not:

  • Modify, copy, or distribute site content without permission
  • Use the materials for commercial purposes without authorization
  • Attempt to reverse engineer any software or algorithms
  • Remove copyright or proprietary notices
  • Extract data through automated means without consent
  • Interfere with service functionality or security features

3. User Content and Data

When using our property management platform:

  • You retain ownership of your property and tenant data
  • You grant us a license to process and store your data to provide services
  • You are responsible for the accuracy and legality of content you upload
  • You must have necessary rights and permissions for all shared content
  • We may use anonymized data for service improvement and analytics

3A. My Condo Platform-Specific Terms

Property & Condo Management

When using My Condo for property management:

  • Property owners are responsible for accurate flat/unit information and layouts
  • Tenant data must be current and obtained with proper consent
  • Property associations must have authority to manage common areas and finances
  • Maintenance requests and vendor coordination must follow local regulations
  • Property photos and documents must not violate privacy or copyright

Financial Transaction Management

  • All rent, maintenance fee, and utility bill data must be accurate
  • Payment processing follows PCI DSS compliance standards
  • Financial reports are generated based on user-provided data
  • Tax calculations are estimates only - consult professionals for advice
  • Overdue payment tracking requires proper notice procedures
  • Security deposits and advance payments must comply with local laws

Multi-Stakeholder Access

  • Property owners control access permissions for their units
  • Tenants have read-only access to their specific flat information
  • Association managers can access common area and financial data
  • Vendors see only assigned maintenance requests and contact details
  • Data sharing between stakeholders requires explicit consent

Platform Usage Limits (My Condo Specific)

  • Maximum 500 flats per property management account
  • Up to 10 properties per standard account
  • Maximum 2,000 tenant records per account
  • Document storage: 50MB per flat, 500MB per property
  • Maintenance request limit: 1,000 active requests
  • Financial transaction history: 5 years retention
  • Utility reading entries: unlimited within fair usage

4. Fair Usage Policy

⚠️ IMPORTANT: All usage must comply with our Fair Usage Policy

Violation of fair usage terms or system abuse will result in immediate account suspension and potential legal action including criminal prosecution under applicable cybercrime laws.

Fair usage limits include:

  • Maximum 100 API requests per minute per user
  • Storage limit of 10GB per account (unless upgraded)
  • Maximum 50 properties per standard account
  • Reasonable use of bandwidth and server resources
  • No automated data scraping or bot usage without permission
  • Maximum 10 concurrent sessions per account

5. Prohibited Uses & Legal Consequences

⚠️ WARNING: System Abuse Will Be Prosecuted

Any attempt to abuse, hack, or compromise our systems will be reported to law enforcement authorities and will result in legal action including but not limited to civil litigation and criminal prosecution.

Strictly prohibited activities that will result in legal action:

  • System Abuse: DDoS attacks, excessive API calls, resource hogging
  • Security Violations: Hacking attempts, SQL injection, XSS attacks
  • Data Theft: Unauthorized data extraction, scraping, or mining
  • Fraudulent Activity: Payment fraud, identity theft, false information
  • Malicious Code: Uploading viruses, malware, or harmful scripts
  • Unauthorized Access: Accessing other users' accounts or data
  • Service Disruption: Any attempt to disrupt or degrade service
  • Spam/Abuse: Sending spam, phishing, or abusive content
  • Reverse Engineering: Attempting to reverse engineer our systems
  • Impersonation: Misrepresenting identity or affiliation

Legal consequences for violations include:

  • Immediate and permanent account termination
  • Forfeiture of all fees paid with no refund
  • Civil litigation for damages (minimum ₹10,00,000)
  • Criminal prosecution under IT Act 2000 and IPC
  • Reporting to cyber crime authorities
  • Public disclosure of violation (where legally permitted)
  • Recovery of all legal costs and attorney fees

6. Monitoring & Enforcement

🔍 Active Monitoring in Place

We actively monitor all platform usage for compliance with our Fair Usage Policy. All activities are logged and regularly audited for security and abuse detection.

Our monitoring systems track:

  • API usage patterns and request rates
  • Login attempts and authentication activities
  • Data access and download volumes
  • Resource consumption (CPU, bandwidth, storage)
  • Suspicious behavior patterns
  • IP addresses and geographic locations
  • Session activities and duration

Enforcement actions: We employ automated systems and manual review to detect violations. Upon detection of abuse, we will take immediate action including but not limited to rate limiting, temporary suspension, permanent ban, and legal proceedings.

7. Fees and Payment

For paid services:

  • Fees are based on your selected subscription plan
  • Payment is processed through secure third-party processors
  • Subscriptions auto-renew unless canceled before renewal date
  • Refunds are handled according to our refund policy
  • We reserve the right to modify pricing with advance notice
  • You are responsible for all applicable taxes

8. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We may suspend or discontinue services for maintenance, upgrades, or security reasons. We will provide advance notice when possible for planned maintenance.

9. Termination

Account termination:

  • We may terminate or suspend accounts that violate these Terms
  • You may cancel your account at any time through account settings
  • Upon termination, your right to use services ceases immediately
  • We will retain data as required by law or legitimate business purposes
  • Certain provisions of these Terms survive termination

10. Disclaimers and Limitations

Services are provided "AS IS" without warranties of any kind.We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, OLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

11. Indemnification

You agree to indemnify and hold harmless OLabs and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of services or violation of these Terms.

12. Governing Law & Data Protection Compliance

🇮🇳 Indian Law Compliance

These Terms and our services comply with Indian laws including the Digital Personal Data Protection Act, 2023, Information Technology Act, 2000, and other applicable regulations.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana, India.

Data Protection Compliance:

  • We comply with the Digital Personal Data Protection Act, 2023 (DPDP Act)
  • Data processing activities follow Indian data protection regulations
  • We do not knowingly collect personal data from children below 18 years without verifiable parental consent
  • Critical personal data is processed and stored in accordance with data localization requirements
  • Users have rights under Indian data protection laws including data correction, erasure, and portability
  • Grievance redressal mechanisms are maintained as per regulatory requirements

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use of services after changes constitutes acceptance of modified Terms.
